By accessing or using Kontext ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Kontext is an AI-powered productivity platform that allows users to create, organize, and enhance content on an infinite canvas. The Service includes features for AI-assisted content generation, collaboration, and context sharing.

3. Account Registration

3.1 Account Requirements

To use the Service, you must:

  • Be at least 13 years old
  • Provide accurate account information
  • Maintain the security of your account
  • Notify us immediately of unauthorized access

3.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to secure your account.

4. Subscription and Payment

4.1 Free Tier

The Free tier includes limited AI credits that refresh every 5 hours. Free tier users have access to basic features with usage limitations.

4.2 Pro Subscription

Pro subscriptions are billed monthly. By subscribing to Pro, you agree to:

  • Automatic recurring billing until canceled
  • The current subscription price (subject to change with notice)
  • No refunds for partial months

4.3 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain Pro access until the end of your current billing period.

5. Acceptable Use

5.1 Permitted Use

You may use the Service for lawful purposes, including:

  • Personal productivity and organization
  • Professional content creation
  • Educational purposes
  • Collaborative projects

5.2 Prohibited Use

You may NOT use the Service to:

  • Generate illegal, harmful, or abusive content
  • Violate intellectual property rights
  • Attempt to bypass usage limits or security measures
  • Distribute malware or engage in hacking
  • Harass, threaten, or harm others
  • Generate spam or misleading content
  • Violate any applicable laws or regulations

6. Content Ownership

6.1 Your Content

You retain ownership of content you create on Kontext. By using the Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service.

6.2 AI-Generated Content

Content generated by AI features is created using your inputs and third-party AI models. You may use AI-generated content subject to:

  • These Terms of Service
  • The terms of the underlying AI providers
  • Applicable intellectual property laws

We do not guarantee AI-generated content is accurate, original, or free from errors. You are responsible for reviewing and verifying AI outputs.

6.3 Shared Content

When you share content via public links, you grant others permission to view and potentially copy that content. You are responsible for not sharing confidential or proprietary information.

7. Intellectual Property

The Service, including its design, features, and underlying technology, is owned by Kontext and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service without permission.

8. Disclaimers

8.1 Service Availability

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service.

8.2 AI Accuracy

AI-generated content may contain errors, inaccuracies, or biases. We are not responsible for decisions made based on AI outputs.

9. Limitation of Liability

To the maximum extent permitted by law, Kontext shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or business opportunities.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Kontext and its affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time for violations of these Terms or for any other reason with or without notice.

Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.

12. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the courts of the Republic of Korea.
